Terms of Use (EULA)

By downloading or using One Mile Closer (the "App"), you agree to these Terms of Use. If you do not agree, do not use the App. This agreement is between you and Zacharia Bouzarouata, sole proprietor, based in Massachusetts, United States ("we", "us", "our").

1. Eligibility

You must be at least 17 years old (or the age of majority in your jurisdiction, whichever is greater) to use the App. By using the App, you represent that you meet these requirements.

2. Your Account

You are responsible for keeping your sign-in email secure and for all activity on your account. You must provide accurate information and may not impersonate anyone else. One person per account.

3. Subscriptions & Billing

• One Mile Closer is a paid subscription. Pricing is shown in the App and on this website before purchase.
• Subscriptions purchased in the App are billed by Apple through your Apple ID. Subscriptions purchased on the website are billed by Stripe.
• Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before renewal.
• You can manage or cancel your Apple subscription in iOS Settings → your name → Subscriptions. Website subscriptions can be canceled by emailing onemilecloserapp@gmail.com.
• Refunds for App Store purchases are handled by Apple at reportaproblem.apple.com. We do not process App Store refunds directly.

4. Acceptable Use & User Content

You retain ownership of the videos and content you record. By sending content to your partner through the App, you grant us a limited license to store and deliver that content to your paired partner. We do not use your content for any other purpose.

You agree not to record, upload, or send content that:

• Is illegal, sexually exploitative of minors, or depicts real violence, self-harm, or abuse;
• Harasses, threatens, defames, or invades the privacy of another person;
• Infringes the intellectual property rights of anyone else;
• Contains malware, spam, or attempts to interfere with the App's operation.

Zero-tolerance policy: We have zero tolerance for objectionable content or abusive behavior. Inside the App you can report your partner or their content (Settings → "Report [partner]", with categories including inappropriate video, inappropriate Locket photo, nudity or sexual content, hateful or abusive messages, and inappropriate requests) and unpair from your partner at any time (Settings → Unpair) to immediately cut off contact. You may also email onemilecloserapp@gmail.com. Every report is reviewed within 24 hours; confirmed violations result in removal of the offending content and termination of the offending user's account.

5. Termination

You may delete your account and all associated data at any time from the Settings screen inside the App. We may suspend or terminate your account if you violate these Terms, in which case any unused subscription time may be forfeited.

6. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free service.

7. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits arising out of your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us in the 12 months preceding the claim.

8. Apple-Specific Terms

If you obtained the App from the Apple App Store, the following also applies:

• These Terms are between you and us, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. Beyond that, Apple has no warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in-app or via email. Continued use of the App after changes take effect constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles.
